POSITION SUMMARY

We have an exciting opportunity for Corporate Counsel to join our fast-paced dynamic legal department at Alere, Inc, in our Kansas City, Missouri office. The ideal candidate will provide superior legal support and services, while having the flexibility to support the Chief Counsel and Senior Counsel for Alere Toxicology, in different office locations. The preferred candidate for our Corporate Counsel opportunity must have a collaborative approach to support the Toxicology team, regardless of locations, while applying a comprehensive understanding of the business in combination with the required legal expertise to achieve business objectives.
ESSENTIAL DUTIES AND RESPONSIBILITIES - (KEY ACTIVITIES)
Negotiate, draft and review an extensive range of agreements for laboratory, medical device manufacturers, and third party administrators, such as confidentiality, lab service agreements, business associate agreements, distribution, consulting, managed care, employment, manufacturing, quality, supply, licensing agreements and government tenders.
Review RFPs and government contracts in healthcare and drug testing context and required legal research.
Advise on employment drug testing laws and regulations.
Assist in advising the business on regulatory, compliance reimbursement, managed care, privacy, stark and healthcare fraud and abuse matters.
Identify, anticipate, counsel on and help mitigate key legal risks
Assist with third party due diligence program, policy review and other matters as requested by the Senior Counsel.
Assist in mergers and acquisitions activities, including due diligence and project management.
Act as technical or functional expert with respect to area(s) of expertise; responsible for remaining up to date on changes in laws/regulations affecting areas of expertise.
Apply expertise to proactively and independently manage projects or relationships critical to the company; responsible for developing innovative approaches to support the company's long-term business goals.
Develop solutions and independently execute strategies in complicated or novel situations.
Serve as a subject matter expert on fraud and abuse and healthcare compliance issues to build consensus and develop policy
Develop expertise on emerging and cutting edge legal issues facing the company
Demonstrate proficiency in areas of corporate law relevant to company's business including without limitation M&A, employment law,
litigation, healthcare regulatory, healthcare fraud and abuse law, employment drug testing laws and regulations.
Navigate and influence complex negotiation processes, build relationships, and gain credibility as partner with business leaders and peers

REQUIRED SPECIALIZED KNOWLEDGE AND
Qualifications:
Licensed attorney at law in one or more jurisdictions in the United States. Admitted and eligible for bar.
Experience counseling clients on health law compliance issues.
Experience in fraud and abuse laws, including the Anti-Kickback Statute and its safe harbors and the Stark Law.
Analytical risk identification, evaluation, and management experience.
Strong ethical compass with business integrity able to work with minimal direction.
Demonstrate flexibility and ability to prioritize continually changing business needs while taking on leadership or team roles as needed.
Excellent communication, presentation, time management and organizational skills.
Excellent written and verbal communication skills.
Demonstrated strong analytical thinking ability.
Ability to work on multiple projects at the same time.
Superior common sense and judgment.
Must successfully pass background & drug screening prior to beginning employment with company.

Qualifications:
Passionate about RFPs and contract reviews in healthcare and drug testing context knowing you are personally making a difference in our industry.
5 years medical device industry experience.
5 years drug screening expertise highly desired.
Familiarity with payer, provider, and reimbursement issues.
Understanding of value-based healthcare, medical devices and third party administrators, highly desired.
